Probate is the legal process in which the assets of a decedent are administered. Probate administration varies depending on the availability or absence of a Will.

Events following the death of a family member are not always easy or simple. Among the many activities that must occur is the distribution of the decedent’s assets. If there is a Will, probate is the legal process in which it is proved valid or invalid. In the absence of a will (intestate), probate is the legal process in which the court appoints a Personal Representative to distribute the decedent’s property as provided by State Statues.In the absence of a Will, distribution can be arbitrary and may or may not reflect what the decedent would have wanted. The benefit of a well thought out Will that clearly states how the assets are to be distributed simplifies the process, limits the expenses involved and guarantees the decedent’s desires are met.
